IR35 still on course for April 2020
It’s just been announced today that whilst an Off Pay Roll review has been commenced, the roll out will still be happening on April 6th of this year. Here’s the briefing link – Government Brief
What it means for the client is a load more administration and the risk of HMRC liability for any existing or future assignments.
We are experts in this.
Put your interims through us and be legally compliant, save yourself the admin headache and we will take on your HMRC liability risk.
Where contracts are put through Corvin Fox we offer the following service:
- Full Contractual Review.
- T&C’s and “Contract for Services” reviewed against upcoming legislation and continually updated against any future changes.
- Full Workplace Assessment.
- A full workplace assessment carried out by our legal partner.
- A report based on case law that will determine whether your current Interim Manager/ Consultant assignments will be inside or outside of the new IR35 legislation from April 2020.
- Recommended actions to take the contract outside of IR35.
- Where the contract is inside of IR35 we will pay the Interim Manager through an Umbrella Company from April 2020.
- An SDS Report.
- This is a legal requirement from HMRC.
- Interim Objections.
- Within the legislation the Interim can object to the SDS decision and ask for the decision to be reviewed. We will also cover this off.
- Changes in Assignment Circumstances e.g. extension, new objective.
- “Contracts for Services” will be updated.
- Workplace reassessment will be carried out.
When this was launched in the Public Sector in 2017 many companies lost good interims and projects failed as they did not deal with this upcoming nettle!
Grasp the nettle now and call us on 01775 729590 to get legally compliant.
Thanks
